Android “born with original sin”, OEMs flocking to Windows Phone 7

A chinese panel of analysts is claiming that litigation issues around Android is pushing OEMs to adopts and increase their involvement in Windows Phone 7.

The China-based 21st Century Business Herald writes:

Some of these vendors worry about the risk of becoming embroiled in patent infringement due to adoption of Android, and have drawn up three  strategies to cope with potential impact. The three strategies are enhancement of support to Microsoft Mango operating system, promotion of smartphone customization by mobile telecom carriers for protection through binding common interest (especially carriers partnering with Apple and Microsoft), self-development of own operating systems, the source pointed out. China-based smartphone vendors Huawei Device and ZTE have planned to adopt Mango, the source indicated.

The same article notes that Android consists of millions of lines of code. “”Google count not have written all the code, it is impossible.” the panel pointed out. They note when Google constructed Android they did not pay much attention to intellectual property issues, resulting in code tainted with “original
sin.”

The article notes than OEMs were watching the response of the market to Nokia’s Windows Phone 7 handsets – if the response is good the whole OS will likely make a come back and see much greater uptake.

        WebOS is built on the Linux kernel. Not clear there’s no patent exposure there too. Indeed, good reason to believe there is.

          You’re right, but then again, Palm had been in the industry a long time so there is also good reason to believe they had enough patents of their own they could use in counter-suits, and that’s not including the patents HP already had. But you never know.

            I think the main thing to take away from this (and as you get older begin to realise the truth of the [paraphrased] idiom) is that:

            “EVERBODY PAYS [i.e. NOTHING IS FREE!!]” Someway, somehow, sometime (sooner or later!). Nobody gets a free lunch! etc I could go on, but I suspect you get the idea! :-)

            The point is that from Microsoft downwards, someone is paying someone else licensing fees to use their stuff! (If you recall Microsoft, just before releasing WP7, announced that they had paid [I think] $90M in licensing fees for use in their O.S. At the time I wondered just whom were they paying?
            So the idea of Google releasing a “Free, Opensource” O.S. that they didn’t wholly create (but of which they tied to a profitable licensing ‘google experience’) is one of the most dis-ingenuous of recent business schemes/plans out there!

            yes, for those patents only HP went to buy Palm. If WebOS is not working out or even if it is working out, HP could reuse those patents for something else too easily.

            Yeah, they have. At the time I thought MS should buy them just to get the patents. And in hindsight it would have kept WebOS away from HP, which would have been to MS’s benefit.

            Agree HP could counter sue. I wasn’t thinking so much MS suing, as they signed a deal with Palm and probably wouldn’t want to piss off their largest PC OEM. I was thinking more Apple if their recent victories regarding Android actually extend to the kernel (which I’m not sure they do, just sayin).

        LOL! Now that would be cool. I like webOS but it doesn’t have Zune or XBOX Live connectivity. :( If it had those I’d be more of a Palm fan and would easily consider it. It’s a great platform.

    Wow. WP7 is about to be on the move, and fast. The design of the Samsung WP, and Nokia WP is gonna be epic. They both have the potential to make a great WP.

    Now they start realizing that they should adopt Windows phone over Android, really???
    So the various bugs, complaints,… and the fact that Android is slow as f*** didn’t indicate any problem to them earlier? I think The OEMs basically have the power to make any OS popular by adopting them as their main strategy if they really want to. I really hope a lot of OEMs are going to have to adopt Windows Phone. They need to flood the market with them. People will buy whatever they’re given in the end and realize that Windows Phone is way better tan anything out there, especially with Mango.

      You’re talking about OEMs who sat back while 1 in 5 smartphones were returned prior to iPhone. So yeah, they’ll put up with bugs, complaints and slow performance. But getting sued and potentially having to pay out a boatload of money gets their attention.

      With Apple’s win against HTC yesterday, Android is in even more legal trouble.

      I wonder, if Microsoft had allowed OEM customization for WP, would Microsoft be standing for them in lawsuits whose scope has crept into Sense, TouchWiz or those other custom interfaces.

    Actually I enjoy reading about any OEM having to pay royalties to M$…lol.

    I couldn’t care less if they adopt on their own or not, sooner or later they have to because WP will be more popular in the future.

      Agree. I don’t like Android and will never buy any Android phone, but without competition, MS will stop producing innovations.

        Because MS is doing such a good job of handling the competition from Apple? Android could go away tomorrow and MS would still be far behind and have its work cut out for it.

      Why is it bad? It’s the market working as it should. OEMs are starting to realize that “free” isn’t free and adjusting their plans accordingly. If Google doesn’t like it, they’re more than wealthy enough to provide blanket indemnification for all their OEMs. Why should Apple or MS allow them to have a free ride?

      So all of a sudden the mobile world and competition will crumble without Android? If Android were to go away, all that would happen is someone else will get a chance to shine and introduce something else to get excited about.

    Microsoft always produce their best work when they are the underdogs. Right now they’re innovating with Windows Phone, Kinnect and Bing. I want a choice of several mobile OS’s. Healthy competition is needed to keep big business honest.
    What interests me is seeing what are Oracle after apart from damages and licensing fees going forward. Do they want to kill Android or do they just want cash from Google? All these other lawsuits are targeting OEMs.

      Let’s not forget that Microsoft just came out of DOJ oversight in April. I have a feeling that that’s all they’ve been waiting for to start firing on all cylinders.
